Are the people from Toll Brothers helping you now? They ought to doing their utmost to help you! Maybe it would help you if you understood how we got action from Toll Brothers when we encountered problems...
When we first signed our contract, we visited the new TB Design Center and we found out from the TB rep that that Toll Brothers was trying to cheat us out of items previously promised: lighting fixtures, quality rugs, certain size tile, granite backsplash....
We reacted to this in writing. We created a paper trail every step of the way. In conversation, we made it clear that we were willing to get a legal remedy (we mentioned that we have lawyers in the family)or that we would go to Consumer Report Magazine if we did not get satisfaction. When we got no satisfaction locally, we escalated the issue, always in writing, always delivered via Fed EX, so we would have a receipt. In the letter we sent to Toll Brothers, we included the printout of a web site which features how "(Toll Clients) cite broken promises". It appears that our stategy worked. Toll Brothers gave us the things we had been originally promised. What's more, we have had excellent service on warranty requests. We were extremely lucky in that we didn't experience any leaks yet.
